Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Atlas Prospector (“Atlas”, “we”, “our”, or “us”) at app.atlasprospect.ai. By creating an account or using the service, you agree to these Terms on behalf of yourself and, where applicable, the organization you represent.

The service

Atlas provides prospecting and enrichment sheets: workspaces where business teams discover companies and contacts, enrich records with additional data, and sync results with connected tools such as Google Sheets and HubSpot. Features may evolve over time; we may add, change, or retire functionality with reasonable notice for material changes.

Accounts

You must provide accurate account information and keep your sign-in credentials secure. You are responsible for all activity under your account. Atlas is a business tool intended for use by professionals and organizations, not by children.

Acceptable use

You agree not to:

• use the service in violation of applicable law, including anti-spam laws (such as CAN-SPAM and equivalent regulations) and data-protection laws that apply to the prospect data you process;
• import or process data you do not have the right to use;
• resell, sublicense, or provide the service to third parties as a service bureau without our written agreement;
• probe, scrape, overload, or attempt to gain unauthorized access to the service or its infrastructure;
• use the service in a way that violates the terms of connected third-party platforms (Google, HubSpot, or data providers).

We may suspend or terminate accounts that violate these rules, with notice where practicable.

Your data

You retain all rights to the data you import into or generate within Atlas. You grant us the limited license needed to host, process, and display that data in order to provide the service. You are responsible for ensuring you have the necessary rights and lawful basis for the data you process through Atlas.

Subscriptions and credits

Paid plans are billed in advance on a recurring basis until cancelled. Certain features consume credits, which are purchased separately or included with a plan. Except as described in our Refund & Cancellation Policy, fees are non-refundable. We may change pricing with advance notice; changes take effect at your next billing period.

Third-party services

Atlas integrates with third-party services, including Google, HubSpot, and Stripe. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for their acts or omissions.

Intellectual property

Atlas, including its software, design, and branding, is our property or that of our licensors. These Terms do not grant you any rights in the service other than the right to use it as described here.

Disclaimer of warranties

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that enrichment data will be accurate or complete.

Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the service is limited to the amounts you paid us in the twelve months before the event giving rise to the claim.

Termination

You may stop using the service and cancel your subscription at any time. We may suspend or terminate your access for material breach of these Terms. Upon termination, your right to use the service ends; data-deletion requests are handled as described in our Privacy Policy.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The parties will attempt to resolve disputes informally before pursuing formal proceedings.

Changes to these terms

We may update these Terms from time to time. Material changes will be announced in the app or by email, and the “Last updated” date above always reflects the current version. Continued use of the service after changes take effect constitutes acceptance.
